New Rule allows DACA Recipients to Apply for Healthcare Coverage

Starting November 1, Deferred Action for Childhood Arrivals (DACA) recipients can apply for healthcare coverage through specific federal programs due to a new rule.


Key Points:

- On May 3, the U.S. Department of Health and Human Services announced the final rule that allows DACA recipients to access healthcare through the Affordable Care Act (ACA) Health Insurance Marketplace or a Basic Health Program (BHP).


- DACA recipients are significantly more likely to be uninsured compared to the general U.S. population, with about 100,000 previously excluded recipients expected to enroll in the ACA Marketplace or a BHP.


- After the rule takes effect on November 1, 2024, DACA recipients will have a 60-day special enrollment period to choose a health plan through the ACA Marketplace. Coverage could begin as early as December 1 for the ACA Marketplace and November 1 for BHP.


- According to U.S. Citizenship and Immigration Services, there were over 530,000 active DACA recipients as of December 31, 2023. This rule aligns with the Biden-Harris Administration’s goal to provide affordable, quality healthcare for all.


- HHS Secretary Xavier Becerra highlighted that over one-third of DACA recipients currently lack health insurance, and expanding their eligibility will enhance their health and well-being and benefit the economy.


- The business community continues to support DACA and the contributions of Dreamers to the U.S. economy. Due to the uncertain legal landscape, DACA recipients eligible for renewal are encouraged to apply promptly. BAL will continue to monitor ongoing DACA litigation and provide updates.
