Temporary Protected Status

Temporary Protected Status (TPS) is a provisional designation granted to citizens of specific countries already residing in the United States who are unable to safely return to their home country due to factors such as armed conflict, environmental disasters, or other extraordinary circumstances.


The determination of designated countries is made by the Department of Homeland Security and is subject to periodic reviews and changes. Typically, a country is designated for an initial period of 12-18 months.


Individuals granted TPS are authorized to work in the U.S. through an approved Employment Authorization Document (EAD).


To qualify for Temporary Protected Status, individuals must:


  • Have been continuously physically present in the U.S. since the effective date of the most recent designation of their country.
  • Have continuously resided in the U.S. since the date designated by the Attorney General for their country.
  • Not have been convicted of a felony or two or more misdemeanors.
  • Not have engaged in persecution of others.
